Can Pomegranate Prevent Prostate Cancer? | Food Trients

By Life Extension

Can Pomegranate Prevent Prostate Cancer?

Pomegranates?are the epitome of a super food ? for no small reason.

In fact, these bright red fruits are one of the richest sources of antioxidants known.

They?ve been shown to protect against a variety of diseases including heart disease,1?diabetes,2?and atherosclerosis.3

But the benefits of pomegranate don?t stop there. In fact, pomegranate juice may slow prostate cancer growth, according to research from UCLA.

Let?s take a look at the research.

Study Finds Pomegranate Slows Rising PSA Levels

In the study, investigators from UCLA recruited men with a prior history of?prostate cancer. They had undergone cancer surgery or radiation, but their PSA levels (a prostate tumor marker) were quickly rising. They were given 8 ounces of pomegranate juice daily for several years.

What they found was striking: The men who drank the juice had slower rising PSA levels.4Specifically, it took 54 months for their PSA levels to double rather than the average 15 months prior to drinking pomegranate juice.

This wasn?t the only human study to find positive results. A more recent one conducted in 2012 showed that pomegranate extract reduced PSA increases as well.5

The goal of prostate cancer therapy is to keep PSA levels as low as possible. And slower increases are a positive sign. But just what is it about pomegranate that makes it so beneficial? Laboratory studies may offer clues.

Pomegranate Offers Anti-Cancer Properties

The best way to attack cancer is through a multi-targeted approach. Cancerous cells work through different mechanisms to grow and spread.

That?s why it?s important to tackle different mechanisms simultaneously for the best results ? an approach which is?rarely?utilized by conventional medicine.

This is also why pomegranate looks so promising ? it attacks prostate cancer in a variety of ways:

    • Pomegranate induces?apoptosis, a process in which cancer cells die.6?Normally, your body kills cancer cells through this process. When apoptosis fails, cancer cells can reproduce uncontrollably.

?

    • Pomegranate suppresses inflammatory markers like?NF-kB?(nuclear factor-kappa B), which is associated with tumor growth.7

?

    • Pomegranate blocks?angiogenesis, the process in which tumors generate new blood vessels.8?Tumors develop their own blood supply in order to obtain nutrients for growth. Cutting their blood supply could essentially ?starve? a tumor and affect its growth.

?

  • Pomegranate stops cancer cell proliferation and invasion of cells.9?Cancer cells become more dangerous when they spread from their site of origin and it?s usually this metastasis that claims the lives of many cancer patients.

The primary benefits of pomegranate are attributed to their ellagitannin content,6?which are phytochemicals with powerful antioxidant properties. Other powerful compounds they contain include caffeic acid and luteolin.10

The Bottom Line

The goal of prostate cancer therapy is to keep PSA levels as low as possible, as rising values can indicate recurrence. To keep levels from increasing, doctors often prescribe therapies such as hormone deprivation, which can produce undesirable side effects.

Regardless, significant strides in prostate cancer research have been made within the last few decades. The five-year survival rates have increased remarkably since the 1970s4, though it still remains a top killer.

That?s why it?s important that men take a multi-modal approach in treating their disease.

The results of the UCLA study are truly remarkable and show promise for men with this condition. Although the pomegranate juice wasn?t ?a cure? per se, it?significantly?delayed PSA values without any dangerous side effects to speak of.

Not bad at all for a fruit, wouldn?t you say?

Helpful Tips On Commercial Real Estate Transactions | Eric Chua ...

It?s harder to find commercial properties. Although there are plenty of commercial investments in the market, these buildings don?t get preferential listings in classified ads or real estate catalogs as do residential listings. This market requires a different set of skills in order to be successful, and with the following tips, you will be able to navigate it properly.

The first step is to find the best lender to finance the transaction. Commercial lending institutions and the types of loans they offer differ from conventional home loans. They can be better for you as a borrower. Commercial loans have larger down payments, but you may avoid any personal blame if it?s a bad deal, and the bank won?t mind as much about you borrowing money for the down payment from friends and family.

Real Estate

TIP! You can find different kinds of brokers. You have a full service broker who works on behalf of both the tenant and landlord, then you have brokers who only work with tenants.

Consider visiting websites that contain a wealth of information beneficial to new and seasoned commercial real estate investors alike. You can never learn too much, so you should study real estate topics regularly.

Purchasing commercial properties is more time-consuming and complex compared to the purchase of a home. You should understand that although this is a huge undertaking, when all is said and done you will receive a big return on the investment.

If you are looking to get financing for your real estate goals be sure to have your business and personal financial statements on hand for review. Without financial statements, a bank cannot verify your income and will not allow you to borrow money.

TIP! You may have to make some repairs or improvements to your property before you can move in. The changes don?t have to be extensive.

It is essential to develop a list of emergency maintenance service providers. Talk to the landlord about who does emergency repairs for your building or office. Be sure to have emergency numbers on hand, and remember to check about a quoted response time for maintenance emergencies. Make an emergency plan once you have this information. If a flood, fire or break-in interrupts your normal business day, you need to have a plan in place so that you can re-open as soon as possible.

Study up to learn the best ways of recognizing good deals and moving quickly to make the most of them. Those who are pros at real estate can quickly tell a great deal from a bad one. They have their exit strategy already planned out, and therefore, they know when to quit a deal and when to stick it out. They also have an eye for repairs, are good at calculating risk, and they are good at knowing when their financial goals align with the properties in question.

Consider the features that your business requires prior to searching for commercial property. Determine what sort of office you will need to run your business. If you want to grow your company, buy a larger space than you think you need. This can save money later.

TIP! The borrower of a commercial loan is the one that orders the appraisal. The bank will disallow any appraisals ordered by other people.

Pro Forma

The key terms will include the pro forma and the rent roll. Failing to review the terms might cause you to encounter a term not encompassed by the rent roll, thus resulting in changes to the pro forma.

Have an online presence prior to getting into the market. You can set up a basic LinkedIn profile or even an entire website. You are also going to want to check out search engine optimization because this can increase your website?s rank on search engines. These principles make it easier for online users to locate your site through search engines.

TIP! You can find different ways of saving on costs of repair when it comes to cleanup. You have to pay for cleaning only if you are the owner of the property.

If you think finding the perfect property is the main hurdle to surmount, you?re wrong. Just a little information goes a very long way.

Ministers face MPs on energy plan

Ministers will be forced to explain to MPs a pledge by the prime minister to make gas and electricity suppliers to offer customers their lowest tariffs.

The statement, expected at 10:30BST, follows an urgent question by Labour, who have been critical of the policy.

David Cameron told MPs that legislation would be brought before Parliament, amid concern over rising energy bills.

But later the Department for Energy said it was looking "at all options" to help customers get the best tariff.

BBC industry correspondent John Moylan says that on the face of it Mr Cameron's announcement on Wednesday amounts to a major change in energy policy - instead of consumers having to seek out the best deals, firms would have to give customers the lowest tariff.

But there is still little detail on how this would actually work, our correspondent says.

One suggestion is that a supplier would send a letter outlining a better deal a customer would be automatically switched to - unless they opted out.

The main energy firms say they knew nothing of the plan or of the government's intention to put this into legislation in the forthcoming Energy Bill.

But on Wednesday night, our correspondent adds, the Department of Energy and Climate Change was playing down suggestions that companies would be forced to move customers onto cheaper deals.

We need a more competitive market. Six companies dominate 99% of the customer base in the UK?

End Quote Caroline Flint Shadow energy secretary

A spokesman for the department said the government had no intention of ending competition - as some critics suggest the plan would - and was looking "at all options" to help consumers get the best tariff, which might not necessarily be the cheapest.

Some households might not want to pay their bills by automatic direct debit to their banks - often the cheapest option - or would want to take energy only from green sources, he added.

Energy Secretary Ed Davey has confirmed the government will publish the Energy Bill in November, for second reading before Christmas.

Last week Npower and British Gas both announced that they were increasing gas and electricity prices in the UK. They blamed the government's policies, as well as wholesale prices.

Ministers have previously encouraged consumers to shop around and make sure they are on the best available deals, but consumer groups have complained that this is making little difference amid rising costs.

At Prime Minister's Questions, Mr Cameron said: "I can announce... that we will be legislating so that energy companies have to give the lowest tariff to their customers, something that Labour didn't do in 13 years, even though the leader of the Labour Party could have done because he had the job."

Mr Cameron said it would be "welcome" news for households facing rising energy costs.

But speaking later on BBC Two's Newsnight programme, shadow energy secretary Caroline Flint suggested confusion surrounded the policy.

"The truth is... this policy isn't going anywhere because the prime minister actually announced a policy that within 10 hours has disappeared," she said.

Ms Flint added that there was a need for more competition within the energy sector.

She said: "We need a more competitive market. Six companies dominate 99% of the customer base in the UK. So what do we need? We need a tougher regulator, and we have announced that we would abolish Ofgem and have a tougher regulator.

"We need transparency, so we can see when companies say 'We can't do this because we need to invest', whether what they are saying is right. And we need to know that when wholesale prices go down they pass on those cuts to the consumers."

Consumer group uSwitch, which runs a price comparison website, said the policy announced by the prime minister would actually disadvantage consumers.

Anne Robinson, director of consumer policy, said: "This has to be a mistake - the unintended consequences would be to kill competition."

She said there would be "no spur, no choice, no innovation and no reason for consumers to engage any more".

But Stephen Fitzpatrick, from Ovo Energy, told BBC Radio 4's Today programme the announcement was "great news" for consumers and would help break the "stranglehold" of the big six energy companies.

"Competition in the energy market has never been so poor... I don't see that consumers are going to lose out from this at all. I think most people will see their bills come down," he said.

"I think some of the larger energy companies might withdraw some of their subsidised deals, but what you're going to see is this surge of competition from independent energy companies."

How Jeremy the College Kid Got on the Stage With Obama and Romney

ABC News' Avery Miller reports:

Although most of us try to avoid telemarketers, Jeremy Epstein's sister didn't. She picked up the phone and was asked by a research company if she was a registered voter. She said no, but her older brother was. She handed him the phone.

That's how Epstein found his five minutes of fame.

After confirming he was an undecided voter, the polling company told him he could attend the presidential debate on Tuesday and ask both candidates one question.

Luckily, Epstein, an exercise-science major at Adelphi University, is still taking unsolicited phone calls and that's how ABC News found him. He picked up the phone at home on the first ring.

He remembered being very nervous when the cameras focused on him in the first minutes of the debate. He asked his question to Gov. Mitt Romney and President Obama.

"What can you say to reassure me, but more importantly my parents, that I will be able to sufficiently support myself after I graduate?" he asked.

Romney offered him a job on the spot.

"When you come out in 2014, I presume I'm going to be president," Romney said. "I'm going to make sure you get a job. Thanks, Jeremy. Yeah, you bet."

We asked him if he had other job offers considering how quickly his first one happened.

Epstein paused.

"Other than the one, really, that Mitt Romney offered me 5 minutes into the debate, not really," he said. "You know, I don't want to be viewed as just some person who went on TV in front of 60 million people and asked the two most powerful men for jobs. I asked the question because it's how a lot of people in my position feel - 20 year old students just like me who are actually really nervous about whether or not they will get a job and how they can support themselves."

He spent part of the day revising his resume. The debate experience is going to be the first thing prospective employers read.

"That's probably going to go at the top - actually my entire resume," he said. "I think that instead of including my previous work history, I'm just going to write, 'appeared and asked the first question on 2012 town hall debate.'"

But Epstein isn't expecting to be part of a potential Romney administration. He still considers himself undecided but leans toward one candidate.

"Well, if the election was today, I probably would vote for the president, so I don't know if you would call me undecided," he said. "But it would be a good label to put me under."

ABC News' Jon Karl labeled Epstein as the real winner in the debate on "World News." Does he feel like a winner and has it improved his social life?

"I found out on Twitter last night that I had a lot more cousins than I thought I did and people knew me who ? I had no idea that they knew me," he said. "People are saying that they went to sleep-away with me. I've never been to sleep-away camp. Stuff like that."

He definitely feels like he won the gold.

"Me being able to ask a question of the president and the governor, I think that's why you'd be able to call me the winner of the debate," he said, "because I think that they both kind of used me as a starting point in getting in their arguments."

Researchers discover new blood vessel-generating cell with therapeutic potential

Wednesday, October 17, 2012

Researchers at the University of Helsinki believe they have discovered stem cells that play a decisive role in the growth of new blood vessels. If researchers learn to isolate and efficiently produce these stem cells found in blood vessel walls, the cells could offer new opportunities for developing therapeutics to treat diseases, such as cardiovascular disease and cancer. The study reporting the discovery of these stem cells is published in the open access journal PLOS Biology on October 16.

The growth of new blood vessels, known as neoangiogenesis, occurs during the repair of damaged tissue and organs in adults. However, malignant tumours also grow new blood vessels in order to receive oxygen and nutrients. As such, neoangiogenesis is both beneficial and detrimental to health, depending on the context, requiring therapeutic approaches that can either help to stimulate or prevent it. Therapeutics that aim to prevent the growth of new blood vessels are already in use, but the results are often more modest than predicted.

Adjunct Professor Petri Salv?n and his team, from the University of Helsinki, now report that these stem cells can be found among the cells?so-called endothelial cells?that line the inside of blood vessel walls. He explains, "we succeeded in isolating endothelial cells with a high rate of division in the blood vessel walls of mice. We found these same cells in human blood vessels and blood vessels growing in malignant tumours in humans. These cells are known as vascular endothelial stem cells, abbreviated as VESC. In a cell culture, one such cell is capable of producing tens of millions of new blood vessel wall cells".

From their studies in mice, the team are able to show that the growth of new blood vessels weakens, and the growth of malignant tumours slows, if the amount of these cells is below normal. Conversely, new blood vessels form where these stem cells are implanted.

"The identification and isolation of an entirely new adult stem cell type is a significant discovery in stem cell biology." explains Salv?n. "Endothelial stem cells in blood vessels are particularly interesting, because they offer great potential for applications in practical medicine and the treatment of patients."

If an efficient method of vascular endothelial stem cell production could be developed, it could offer new treatment opportunities in situations where damaged tissue or diseases call for new blood vessel growth, or where the constriction or dysfunction of blood vessels deprives tissues of oxygen, for example in cardiac disease. These cells also offer new opportunities for developing therapeutics that seek to prevent new blood vessel growth in malignant tumours.

Acer outs T232HL and T272HL touchscreen displays, coming this month for $500 and up

It must be Big Touchscreen Day over at Acer headquarters. In addition to announcing a pair of all-in-one desktops, the company is trotting out two touch-enabled monitors, available in 23- and 27-inch sizes. Though both have 1080p resolution, the 23-inch T232HL uses IPS technology to achieve wide viewing angles, while the larger T272HL has a Vertical Alignment (VA) panel. Otherwise, the specs are near-identical: a 100 million to 1 contrast ratio, 5ms response time and a trio of inputs that includes VGA, DVI and HDMI. As for design, you'll notice they have a similar industrial design as the new all-in-ones, with thin frames, edge-to-edge displays and a see-through stand. Both will be available this month, with the 23-incher going for $500 and the 27-inch model selling for $700.

Evidence of fall spawning by Atlantic sturgeon in Virginia river

Monday, October 15, 2012

Scientists studying the Atlantic sturgeon, one of the oldest species of fish in the world, have found evidence that the James River population in Virginia spawns in the fall, according to scientists at the Virginia Commonwealth University Center for Environmental Studies and VCU Rice Center.

The finding challenges the longstanding view that this specific species only spawns in the spring and may ultimately lead to the development of guidelines and protections for future management and recovery of the fish. Experts assume that there is spring spawning here in the James River, just as there is one in the Hudson River and in some of the few remaining other rivers with the fish. Therefore, there may be some unique ecological trait of the James River yet to be determined and understood.

Little is known about the biology and life history of the sturgeon. There has been a significant decline in the number of fish in the past 100 years, due largely to overharvesting and the construction of dams that have altered its habitat. Between 1900 and 1920, nearby fisheries collapsed and the James River population was assumed to be extirpated as recently as 10 years ago. All populations of Atlantic sturgeon were given protection under the federal Endangered Species Act earlier this year. The James River fish are considered to be endangered.

In a new study published online this month in Transactions of the American Fisheries Society, a journal of the American Fisheries Society, researchers report empirical evidence of fall spawning by the Atlantic sturgeon in the James River in Virginia. During the three-year study, the team captured and observed 125 adult Atlantic sturgeons to determine sex and stage of maturity, track movement of adults via ultrasonic tags and collect data and examine seasonal frequency of reported vessel strikes on sturgeon.

In the study, breaching of adult sturgeon was reported by a number of fishers, guides and watermen starting in August 2010 and lasting for several months. One female that was captured in the three-year window showed signs consistent with female sturgeon that had spawned recently.

One notable observation ? following the publication of the study ? was a spawning female sturgeon that was captured and released at the end of September 2012 near Hopewell, Va.

"There is still a lot about this population of Atlantic sturgeon that we do not know," said co-author Greg Garman, director of the VCU Center for Environmental Sciences.

"We're still in discovery mode and as we uncover new things we'll be much better able to protect and restore it. We need to learn how we can share this part of the James River with this iconic and now federally protected species," he said.

According to Garman, the VCU research team will next identify critical habitats used by Atlantic sturgeon in the James and try to understand more about the biology and ecology of young sturgeon, which reside in the river for several years before starting oceanic migrations. Research will focus on effective management and recovery of this unique species.

There are approximately 20 different species of sturgeon worldwide and almost all of those are in peril of some form. Individual populations within the species have been extirpated - completely lost beyond recovery.

Cluster bombs used on Syrian civilians, group says

Herve Bar / AFP - Getty Images

A man who lost a member of his family cries as he sits outside his destroyed home following a government air strike in the town of Maaret al-Numan in Idlib province on Saturday.

By NBC News staff and wire reports

Updated at 10:38 p.m. ET: Syrian government forces have dropped Soviet-made cluster bombs over civilian areas in the past week as they battle to push back rebel gains, Human Rights Watch said on Sunday.

The bombs were dropped from planes and helicopters, with many of the strikes taking place near the main north-south highway running through the northwestern town of Maarat al-Numan,?HRW said in a report.

"If we needed any further proof of the Syrian government's complete disregard for the lives of its own citizens, its own children, well, here it is. ?Because we know now that the government is using cluster munitions in populated areas," Philippe Bolopion?of Human Rights Watch said in a video statement. ?"And of course these weapons are extremely dangerous for the civilian population and the children."

The munitions, which first detonate in midair and release bomblets over a wide area, can remain active for years, the rights group said.?Children, who often pickup the munitions, are especially vulnerable to cluster bombs.?

NATO leaders discuss the volatile situation along the Turkish-Syrian border following last week's shelling of a village by forces loyal to Syria's government. NBC's Jim Maceda reports.

Opposition: Syria rebels capture air base as clashes break out across country

Residents from Taftanaz and Tamanea -- both near Maarat al-Numan -- told HRW interviewers that helicopters dropped cluster munitions on or near their towns last Tuesday. One that hit Tamanea released smaller bomblets in an area between two schools, a resident was quoted as saying in the HRW report.

"The bomblets that exploded were the ones that hit the ground on the tip, we collected the ones that didn't explode, their tip didn't touch the ground," the resident said.

Photos: Who are the Syrian rebels?

HRW previously reported Syrian use of cluster bombs, which have been banned by most countries but not Syria, in July and August but the renewed strikes indicate the government's determination to regain strategic control in the northwest.

Researchers identified the the munitions as Soviet-made RBK-250, which would be particularly dangerous because old weapons are less likely to detonate on impact,?Bolopion said. New York-based HRW did not know how or when Syria acquired the munitions.

Turkey: Syria plane carried Russian-made munitions

Rebels seized Maarat al-Numan from President Bashar Assad's troops last week, cutting the route from the capital Damascus to Aleppo, Syria's biggest city. Government forces have been trying to retake the area since then.

Andrea Mitchell talks to Ambassador Dennis Ross about the escalating tensions between Syria and Turkey, and what both presidential candidates are saying they'll do about the situation.

Towns targeted included Maarat, Tamanea, Taftanaz and al-Tah. Cluster bombs were also used in other areas in Homs, Aleppo and Lattakia provinces as well as near Damascus, the rights group said.

Initial information about the use of the explosives came from videos posted online by opposition activists although HRW investigators said it had confirmed the incidents in interviews with resident in two towns.

Turkey forces Syrian plane suspected of carrying weapons to land

People were taking away unexploded bomblets as souvenirs, a highly dangerous action as they can still explode at the slightest touch or movement. Video showed some civilians carrying the bomblets around and throwing them on the ground.

"The cluster munition strikes and unexploded ordnance they leave behind pose a huge danger to civilian populations, who often seem unaware how easily these submunitions could still explode," Goose said.

Who are the Syrian rebels?

Syrian government officials were not immediately available to comment on the HRW report.

Meanwhile,?Turkey banned all Syrian aircraft from its air space on Sunday, days after intercepting a Syrian airliner carrying what it said were Russian-made munitions for the Syrian army.

Asked if Syrian aircraft were now banned from Turkish air space, a Foreign Ministry official said: "Yes, civilian aircraft. Military aircraft were de facto banned way before."

Syria said on Saturday that it was banning Turkish civilian flights over its territory.

VMware adds support for Apple's iOS to Horizon mobile management suite

Steve Evans Published 11 October 2012

Company shows how mission-critical apps can be accessed on iPhones and iPads

VMware has added support for Apple's iOS to Horizon, its mobile app management platform. At the VMworld Europe 2012 conference in Barcelona the company also confirmed a beta version of the Horizon Suite will be available during Q4 this year.

VMware's Horizon platform aims to offer businesses a way to provision enterprise applications on mobile devices, giving workers access to mission-critical apps and data on their personal devices, without compromising on security or other business policies.

The suite is a combination of a number of VMware technologies, such as Horizon Mobile, AppBlast and Project Octopus, the company's file-sharing and syncing app. It lets IT control the use of business-critical applications while ensuring end-users can use the mobile device they want.

VMware has previously demonstrated how the Horizon Mobile technology works on Android devices, but not handsets running Apple's iOS operating system. However during his keynote at the conference CTO Steve Herrod demonstrated how it works on iPhones and iPads.

Rather than creating two separate identities on the device, which is how it works on Android, the technology works on individual apps, ensuring that company policies are met. From a security point of view, Herrod said that policies can be set that block sensitive content from being copied from a business app and pasted into a non-business app such as a social network or a notepad-style app.

Speaking to CBR, Vittorio Viarengo, VMware's vice president of end-user computing, said the company is looking at changing the way companies manage mobile provisioning, moving from managing the devices to managing the data.

"IT needs to get out of the business of managing the devices and work out a way to deposit a secure bubble of applications and data on any device," he said. "Microsoft is very good at managing Microsoft, Apple doesn't acknowledge there is a world beyond Apple and Google has very good solutions across the layers but they don't have a lot for legacy Windows management. So there is a space to fill; how you aggregate these different technologies to deliver a multi-device workplace, and that's what Horizon Suite does."

"We want to flip management upside down and manage from the middle rather than the individual container," he added. "So you set policies on users, applications and data, so as new devices come to market we just have to build that spoke for integration; the policies sit in the middle. So for example as soon as Windows Phone 8 is out we will support it."

Viarengo also confirmed to CBR that the Horizon Suite will hit beta before the end of the year with general availability expected three to six months after that.

FDA regulation of pharmacies has knotty history

WASHINGTON (AP) ? The deadly meningitis outbreak linked to contaminated pain injections has prompted calls for tighter federal regulation of compounding pharmacies, which have periodically been blamed for crippling and sometimes fatal injuries. But this isn't the first time Congress has pushed for more authority over the industry.

Such efforts stretch back to the 1990s, and after vigorous pushback by compounding pharmacists, they have left a patchwork of incomplete, overlapping laws, contradictory court rulings and overall uncertainty about how much power the Food and Drug Administration has to regulate compounders.

And with a gridlocked Congress at its most unproductive in decades, experts don't expect to see new laws passed anytime soon.

The issue flared up in the past several days after the New England Compounding Center of Framingham, Mass., came under suspicion as the source of the tainted steroid shots that have sickened at least 184 people in 12 states, causing 14 deaths.

Several members of Congress this week promised to introduce legislation giving the FDA greater authority to oversee the specialty pharmacies, which custom-mix drugs for patients for everything from menopause symptoms to cancer. The compounding industry in the U.S. has grown into a $3 billion business with 7,500 pharmacies, according to its trade group.

"It's incredibly complicated to explain what our authority is and is not, and the nuances of that," Deborah Autor, FDA's deputy regulatory commissioner, said Thursday. She suggested the FDA would support new laws to oversee the industry.

"The world has changed a lot since the days of mortar and pestle, and this is the time for pharmacists, for lawmakers, for regulators and for doctors to sit down to grapple with this new model of pharmacy compounding," Autor said.

Compounding pharmacies are critical for patients who need solutions, creams and other medicines customized for, say, smaller dosages or to remove ingredients that cause allergies. Unlike drugs that are manufactured for mass-market distribution, these products are not subject to premarket review by the FDA.

All pharmacies, including compounding pharmacies, have long been regulated by state pharmacy boards, many of which date back to the 19th century. At that time nearly all drugs dispensed in the U.S. were individually compounded by pharmacists. The law that created the FDA in 1938 gave the agency strict authority over drug manufacturers, which quickly eclipsed pharmacists as the main producers of prescription medicines.

For decades, the state-federal divide persisted, with states overseeing compounding pharmacies and the FDA policing drug manufacturers.

But in the 1990s, FDA regulators began to more closely scrutinize compounding pharmacies, as their number multiplied and some grew into big businesses. Instead of making individualized products based on a physician's prescription, companies began mass-producing products and promoting them broadly.

"When you get into that situation, pharmacy compounding can be a disguise for unregulated manufacturing," said Michael Labson, a food and drug attorney in Washington. Recent drug shortages caused by consolidation among drug manufacturers, among other factors, have only increased demand for compounded alternatives.

In recent years some compounding pharmacies have been blamed for outbreaks caused by contaminated medicines. Two people were blinded in Washington in 2005. Three died in Virginia in 2006 and three more in Oregon the following year. Twenty-one polo horses died in Florida in 2009. Earlier this year, 33 people in seven states developed fungal eye infections.

Compounding experts, including the president of the leading compounding pharmacy trade group, believe the New England Compounding Center crossed the line into full-scale manufacturing. Indeed, the FDA had warned the company in 2006 about compounding and distributing anesthetic "for general distribution" rather than for individual prescriptions.

FDA officials said they followed up with the company after sending the warning letter but did not re-inspect it.

"They assured us they were adequately protecting patients and complying with applicable laws and regulations," Autor said. "We took some action, but it's very complicated ? our ability to take action here."

A spokesman for New England Compounding Center had no comment.

FDA officials have repeatedly stressed the challenges the agency faces policing compounding operations. In fact, some former agency officials say that the FDA is hesitant to act after years of legal battles with lawyers and lobbyists for the industry.

The International Academy of Compounding Pharmacists has spent more than $1 million lobbying Congress in the past decade and has a track record of defeating measures opposed by the industry. A 2003 provision to set up an FDA advisory committee to oversee compounders was killed by then-House Majority Leader Tom Delay, who said it would create unnecessary federal interference. Delay represented Sugar Land, Texas, the headquarters of the compounding academy.

The group's president said Friday he would "absolutely" cooperate with the FDA and Congress on new laws to prevent outbreaks.

"The behavior and actions of this one particular business resulted in the deaths of people, and that is antithetical to what pharmacists do," David Miller said. "Whatever they were doing, we have to make sure it never happens again."

But he added that New England Compounding Center appeared to be acting as a manufacturer, which is "contrary to what a compounding pharmacy is all about."

Even when the FDA has succeeded in getting legislation through Congress, it has gotten tangled up in the courts. In 1997 Congress passed an FDA-supported law that allowed the agency to regulate compounding pharmacies if they overstep certain standards for drug production, labeling and advertising. Specifically, the law said that compounding pharmacies were subject to FDA oversight if they advertised their products.

A federal appeals court sided with pharmacists and ruled that this last requirement was unconstitutional, and the Supreme Court upheld the decision in 2002. But the court did not rule on whether the other requirements in the law should stand, creating a legal limbo for regulators. Since then, different appeals courts have issued conflicting judgments on the remainder of the law, which could wind up back at the Supreme Court.

Still, some former agency lawyers say new laws are not necessary when dealing with companies that have clearly crossed the line from compounding drugs to full-blown manufacturing.

"Legislation isn't necessary here," said Sheldon Bradshaw, former FDA chief counsel during the Bush administration and now an attorney in Washington. "FDA already has all the authority they need to go after the New England Compounding Centers of the world. I'm honestly shocked by how FDA is now downplaying its authority in this regard."
